Abstract

The study deals with one of the significant subjects in Shariah and law is that how to treat with doubt in debts. The study reached that there is no rule which says doubts in debts are for the benefit of indebted yet; there are other texts or sayings which focused on the same meaning as Asharnbalali said no rule of doubt in debts. The study showed that the rule which says doubt is interpreted for the debtor interest is applied in Islamic Sharia and modern law that made by man. This can emphasize that the basic source for legislation in Islamic Jurisprudence since Islamic Sharia was revealed before the modern law..
