Abstract

The study examines the jurisprudential issues in which Ibn Rushd; the Grandson differed from his grandfather, Ibn Rushd; the Grandfather, within the Book of Marriage in Bidayat al-Mujtahid. The research consists of an introduction and one chapter, which includes a preface and three sections. The Introduction discusses the general importance of knowledge and highlights the particular significance of Islamic jurisprudence (Fiqh) for both individuals and society. The preface addresses the concept of divergence (Mukhalafat), defining it both linguistically and terminologically. Section one discusses the minimum amount of the dowry (ṣadāq). Section two examines the validity of manumission (ʿitq) as a dowry. Section three analyzes the legal ruling concerning marriage contracted by a person suffering from a terminal (feared) illness. The study ends with a summary of the findings, followed by a list of references.
