Reception of Ibn al-Hajib in the Central Maghreb and Its Impact on Scientific Education

Ibn al-Hājib left a profound scholarly impact across several disciplines, including jurisprudence, legal theory, creed, Arabic grammar, and Qur’anic readings. This paper examines the contexts of his reception and influence in Algeria, addressing the pedagogical crisis that accompanied the teaching of the Mālikī school, and investigating the reasons behind the diminishing focus on his works and the rise of other texts in their place, such as those of al-Subkī, Khalīl, and the creedal writings of al-Sanūsī.

The study employs the descriptive method to analyze the historical contexts, and the analytical method to examine scholarly writings and utilize them in understanding the development of pedagogical practice in Algeria.

Our findings indicate the presence of an educational crisis among the scholars of the Central Maghreb and show that they relied on Ibn al-Hājib as an interim solution in scholarly formation until instructional abridgments became the standard in teaching. Critical perspectives toward these pedagogical methods persisted, though they were later revisited and refined with the advent of the modern scientific revival.

This study examines the waiver of the hadd punishment for defamation (qadhf) through the forgiveness of the defamed person, an issue that has generated juristic and legal disagreement regarding the nature of the hadd and the effect of the victim’s pardon on the lapse of punishment. The importance of the study stems from divergent juristic views on whether the hadd of qadhf constitutes a right of God, a right of the individual, or a shared right combining both.

The study concludes that juristic disagreement over entitlement to the hadd of qadhf has directly influenced rulings on the effect of forgiveness on the punishment. It also finds that Iraqi law gives precedence to the victim’s interest over the public interest. Accordingly, the study recommends reconsidering certain related legal provisions to achieve a balanced approach that protects personal honor while respecting the will of the victim.

Arabic letters, including those of the Holy Quran, are divided into two types: structural letters and semantic letters. Semantic letters have multiple uses, including literal and metaphorical. One of the semantic letters mentioned in the Holy Quran is the preposition "Hata" (حتى), which appears 142 times in 138 verses. This letter has various uses, such as indicating direction or purpose. It precedes the verbal noun with different frequencies, and sometimes indicates the beginning of a condition or purpose. Scholars derived their principles from Arabic language, including the study of semantic letters like "Hata". They developed various rules regarding the implications of this letter, particularly in legal issues such as the rulings on demolition and marital relations before ritual purification. This study aimed to determine the impact of internal determinants of capital adequacy in Kuwaiti Islamic banks during the period 2015-2024. Capital adequacy was considered the dependent variable, while the independent variables were return on assets, return on equity, loan-to-deposit ratio, equity-to-assets ratio, operational efficiency ratio, and bank size. The study employed a descriptive-analytical approach, utilizing descriptive statistics, correlation analysis, diagnostic tests, multiple regression models, and hypothesis testing to arrive at its findings.

The study concluded that the combined independent variables have a statistically significant impact on the capital adequacy ratio. This indicates that the model as a whole possesses good explanatory power and that the selected variables are suitable for explaining changes in the capital adequacy ratio of the banks in the sample. The study recommends strengthening sustainable profit policies and linking them to long-term capital levels in a way that ensures banks' ability to withstand unforeseen risks.
